Terms and Conditions

VERY IMPORTANT PLEASE READ

Please keep your Flight Ticket in a safe place as you must have it with you on the day of your flight.

1. Cooling Off Period
1.1 Under the Competition and Consumer Protection Commission Regulations you have a right to cancel your flight Ticket within 14 days of purchase. To cancel you must notify us in writing or by e-mail of your wish to do so. Your Flight Ticket will then be cancelled on our system. As Flight Tickets are a personalised item, there will be an admin fee of €15 per Flight Ticket if cancelled within the 14 day ‘cooling off’ period, or as otherwise defined in section 7.2 If a flight is booked within the 14 day period, this is deemed as acceptance of these Terms and Conditions and a refund no longer applies This right applies only to the purchaser of the Ticket and not any other third-party. Otherwise, after 14 days, these Terms & Conditions are deemed to be accepted.
2. All Flight Tickets (hereon after referred to as Tickets)
2.1 All Flight Tickets are valid for a period of 2 years from the date of purchase. If your flight is not taken within this time, you will lose the right to participate in a flight, except where the validity period of the Ticket has been extended under Clause 6.
2.2 Sky High Adventures will offer potential flight slots to Ticket holders and will provide specific information relating to the flight i.e. meeting time and place, once the flight confirmation has been issued. We will prioritise specific requested dates at the request of the Ticket holder, where availability exists
2.3 All Tickets are transferable to third parties and are valid as set out herein. The terms and conditions apply to the Buyer or the holder of a Ticket.
3. Initial Contact
3.1 As we require detailed contact information from each Ticket holder, you are advised to make your initial contact with us as early as possible in order to provide that information, allowing us to schedule a flight. The company will respond with a form for completion. This form can be found at https://www.skyhighadventures.ie/reservation/ It is the responsibility of the Ticket holder to contact our company to provide this information. As ballooning is weather dependent, it may take more than one attempt for your flight to take place. If this advice is not followed, this may result in limited availability for you to be offered a flight and could result in the expiry of your Ticket and the loss of your flight
3.2 It is important that these Terms and Conditions are made known by the purchaser to any third party for whom the Ticket is purchased as a gift.
3.3 In addition to booking specific dates for passengers, we also provide the option to accept short-notice flight slots. When this option is selected, we will contact validated Ticket holders, by text or email message, to advise of upcoming flight slots. Ticket holders simply reply to the message to confirm availability or otherwise. Flight confirmations will be confirmed on a first-come first-served basis. This process minimises weather cancellations normally associated with the choosing of random future reservation dates. Of course, we will prioritise dates for special occasions where we have been notified in advance. There is no obligation for Ticket holders to accept any specific flight dates
4. Postponement
4.1 You may postpone your flight reservation 72 hours or greater before the meeting time for the flight.
4.2 Any postponement must be by telephone on 01 254 2600 during office hours (Mon-Fri, 10am – 3pm). Email or answerphone messages cancelling a flight reservation are NOT acceptable.
4.3 If you do not give notice of postponement in accordance with this Clause and are not at the meeting location in time to take part in your scheduled Flight, you will not be entitled to a re-scheduled flight nor to any refund.
5. Flight Conditions
5.1 The Ticket will entitle you to participate in a flight at a date to be arranged within 2 years of its purchase including, where appropriate, assisting with the preparation and inflation of the Balloon, a flight of approximately one hour and arrangements to return you to the meeting point.
5.2 Flights are dependent upon the weather conditions and are regulated under aviation regulations. It may be necessary to postpone a flight at any time if, in the judgment of the Pilot or the company, conditions are not safe or the flight would not be permitted under the above aviation regulations. We will give you as much warning as operational procedures allow of the flight postponement, but this could be any time up to, and including, the moment of launch. Please note that flights can be postponed several times due to a run of unsuitable weather. As a result, patience can be required before suitable weather arrives. If your schedule does not support potential repeat of postponements, we would suggest returning the flight tickets, within 14 days of purchase, for a refund.
5.3 In the event of a flight being cancelled due to adverse weather conditions, or for any other reason by us, upon contacting our office we will offer you alternative dates as soon as reasonably possible after the cancelled flight. Should your flight be cancelled towards the end of our typical flying season (September/October), you should make contact in March in order to secure another reservation for our following season, which commences in April.
5.4 We do not accept liability for any costs, expenses or damages consequential or otherwise the Buyer or Ticket Holder has or may incur if we have postponed or cancelled any flight for any reason
5.5 It is intended that the balloon flight will last for approximately 1 hour but the pilot has ultimate responsibility for deciding the duration and conduct of any flight. The pilot is responsible for deciding the appropriate time and place of any landing. We cannot guarantee that the flight will follow any particular direction or land at a specific location or last for a specific length of time. However, if the flight duration is less than 30 mins, due to safety reasons, the Ticket holder will be offered another flight at no further cost.
5.6 If, due to circumstances beyond our control, we have to withdraw or change any advertised launch site, an alternative location will be offered at a distance of no more than 20 kms from the original site.
6. Ticket Extensions & Upgrades
6.1 If the Ticket holder has not had any Flight dates accepted prior to the expiry date shown on the Ticket but would still like to fly, they may purchase a further twelve months validity from the Ticket expiry date at a cost of £50 per person. Extra validity must be purchased prior to the Ticket expiry date by contacting our office.
6.2 If the flight Ticket expires, and a flight has not taken place due to weather cancellations, the flight Ticket will be extended by one month (of our flying season of April to October) per cancellation.
6.3 The validity of the Ticket may be extended by us if an event outside our control, such as Foot and Mouth Disease or medical pandemic, makes the provision of the flight impossible. The extension will be for the same period as the duration of the restriction. The Ticket holder will be advised of any extension when they contact us either to book or confirm their flight.
6.4 If you are unable to fly during the validity period of your Ticket because you are pregnant, we will extend the validity period by twelve months. This extension can only be provided once. The request for such an extension must be requested prior to the Flight Ticket expiry. It cannot be done retrospectively.
7. Refunds
7.1 Tickets are not refundable except where a proven medical reason prevents you flying. In which case you must notify us, by writing or email, stating the reason preventing you from taking your flight and supply a doctor’s certificate confirming that you have been and will remain to be unfit to fly during the entire period of the Ticket validity. In these circumstances we will refund the cost of the flight less a €25 administration charge, per passenger, plus any card transaction fees, if applicable. This will also be the case in the event of the death of the Ticket holder. Refunds are not available due to weather postponements, which are outside the company’s control.
7.2 Where flight tickets are purchased by tourists, who can only fly on one given date, and that date does not have suitable weather for a safe or legal flight, any payment will be refunded, less the €15 per passenger charge as shown in section 1.1.
8. Fitness to fly
8.1 We are not qualified to express an opinion confirming your fitness to fly. It is your responsibility to ensure that you are fit to fly. You must not fly if you are suffering from any serious medical condition (including, but not limited to, epilepsy, fits, severe head injury, untreated high blood pressure, heart conditions) or have recently undergone surgery, unless you have a certificate from your Doctor confirming your fitness to fly. You MUST tell us about any other disability or health condition that may affect the safety of yourself, or other balloon occupants, (including, but not limited to, transmissible conditions, deafness, sight problems, mobility problems, mental health issues, learning difficulties, inability to understand / follow instructions or hip / knee replacement surgery). If you have purchased a Ticket for another person, please ensure that they are aware of these restrictions.
8.2 You must not fly if you are pregnant, please see paragraph 6.4 for further information.
8.3 Our paramount consideration is your safety and the safety of other passengers participating in the flight. You must obey all requests and instructions issued by the pilot or any of our representatives and take particular care to abide by all safety instructions given. You must not fly if you are under the influence of alcohol or drugs (or appear to be). The pilot has complete discretion as to whether to allow you to take part in the flight and will refuse to allow you to
do so if, in their opinion, you would be a danger to the balloon or its occupants. If you are refused to fly at the time of meeting you will not be able to rearrange your flight, your Ticket will be invalid and no refund will be given.
8.4 As detailed in aviation legislation, our balloons are loaded according to weight and it is important that you provide us with an accurate weight (fully clothed) when booking a flight. If you weigh 18 stone (115kg) or over then you must purchase a weight supplement at €80 per passenger prior to booking a date for your flight (maximum weight 20 stone (127kg)). We carry weighing scales and reserve the right to weigh any passenger at the launch site prior to take off and if, on the day of your flight, you weigh 18 stone or over and have not purchased a weight supplement, you will not be permitted to fly. You will not be able to rearrange your flight; your Ticket will be invalid & no refund will be given.
9. Additional Provisions
9.1 We will not fly children under the age of 12 years or 1.4m tall. A child under the age of 16 years will only be flown if accompanied by a responsible adult
9.2 You should wear such appropriate clothing as is advised to you in advance of the flight and as further detailed in our website FAQs
9.3 Vehicles parked at the meeting point for a flight and their contents are left at your risk and we accept no liability for any loss or damage to your vehicle or its contents.
10. Insurance
10.1 We carry insurance cover against the risk of injury or damage to passengers during the course of our flights as laid down by European Air Transport Regulations to a maximum limit of £1 million. If you do not consider that the amount of insurance cover would be adequate to compensate you for any loss whether for death, personal injury you should take independent advice to arrange additional cover. We will not be held liable for any loss or damage to clothing, equipment or effects brought with you onto the flight nor for death or personal injury unless it has been caused by our recklessness or lack of duty of care.
11. Privacy Policy
11.1 We are committed to maintaining the trust and confidence of our customers & passengers and, most importantly, we will never sell, rent or trade your personal data with other companies or businesses for marketing purposes. 12. Pandemic specific information
12.1 Sky High Adventures fully conforms to Government guidelines relating to any pandemic or health issues and this policy is frequently reviewed in line with Government policy and advised, if necessary, within the reservation confirmation email.
